A street sweeper in Aurora, CO found
hundreds of sensitive dental patient records scattered near a
Dumpster behind a shopping center on October
2nd.
In what could be considered a gross
understatement, the report states that the street sweeper called
the discovery an act of "carelessness."
The report also states that the dentist
office responsible for protecting the records is more than 20 miles
away. The dentists are saying they have no idea how the incident
happened.
According to the report, the authorities are
now investigating.

It's happened again.
According to a report in The Canadian
Press, personal medical information was found blowing down a
Calgary street. The records were said to include names, birth
dates, and surgical procedures.
The privacy commissioner's office says there
have been several instances of confidential records being
misplaced, citing one example of some being found in a dumpster
behind a hospital.
The article states that the incident is under
investigation, however, given the chronic nature of this type of
breach, NAID-Canada and others are calling for stronger direction
and stronger legislation.

According to a report posted on the NYU
Langone Medical Center website, when documents containing personal
information were mistakenly discarded, compacted and buried in a
landfill by New York State Medical Center's Hospital for Joint
Diseases (HJD), the hospital was required to provide breach
notification to approximately 2,600 patients that their personal
information was at risk.
Medical facilities often lose sight of the
fact that improperly discarded paper documents can also result in
data breach notification incidents. According to the recent
information from the US Department of Health and Human Services, as
many as 20% of the hundreds of breach notifications per year
involved lost or improperly discarded paper records.

For years, NAID has been arguing that the
auctioning of the contents of abandoned storage units to the
highest bidder puts personal data at risk.
When you consider that up to one-third of all
self-storage units contain business records, it is hard to see how
they get away with selling them to the highest bidder," says NAID
CEO Bob Johnson.
The recent article on the case of Athens
native Bobby Roberts is a perfect example of the problem Johnson
cites.
Most of the article goes on to discuss the
responsibility of medical professionals to safeguard records. There
is no mention of the fact that the storage company, as the "legacy
custodian," also had a legal responsibility to protect those
records.
"To our knowledge," adds Johnson, "only
California and Indiana have addressed the issue by providing the
legacy custodian a safe harbor. Barring such regulations, anyone
can buy these personal records and have no responsibility for their
protection."

A release by the Indiana Attorney General Greg
Zoeller reports that an Indiana-based insurance company will pay a
$100,000 fine and take other steps for waiting months to notify
authorities of a data breach. According to the release, Wellpoint,
the Indianapolis-based parent of Anthem Blue Cross and Blue Shield,
has agreed to pay the fine; provide up to two years of credit
monitoring and identity theft protection to affected customers, and
reimburse up to $50,000 for breach-related losses.
HIPAA now requires all Covered Entities and
Business Associates (vendors) to report data breaches to
authorities, affected consumers and, in some cases, the media.

On June 10, 2011, the Department of Health and
Human Services (HHS) awarded to KPMG a $9.2 million contract to
create an audit protocol and to then audit covered entities' and
business associates' compliance with the privacy and security
requirements of the Health Insurance Portability and Accountability
Act of 1996 (HIPAA).
